Can a contractor just put a lien on my property?

The contractor I hired gave me a verbal price for my bathroom. I paid one-half to start. When I paid the last half he said that wasn't right and I owed him more money. We argued and then he said since he was going to do my kitchen he'd let it go. I said no way, get out of my house. A week later I get a notice that he put a lien on my condo for even more money. I can't afford a lawyer. Can someone just go an file a lien without proof? Is that legal? What are my rights?

Short Answer: Yes, with a but... Long Answer: No, with an if...

Under Illinois law, one who adds value to real property by performing repairs, supplying materials and labor, etc. is entitled to a claim for the value of the uncompensated work and materials in place. That said, the claim must arise from a valid contract and is limited by the amount of value added (or material supplied, etc.).

There is really much more to this than can be encompassed here, so I recommend that, even if you feel you cannot afford legal assistance, you at least confer with Prairie State Legal Services or contact your County Bar Association. This is a serious matter and should not be ignored.
