CA_Preliminary notice

California

Legally, can I use the same wording as a CA-Preliminary notice template on our own Proposal given to our customers? Would that effect any legal matter? Or do you recommend for us to use the same template provided by the state? I appreciate your your help.

Hello, Is your goal to try to avoid separately serving a preliminary notice upon your customer? Or is there another reason why you want to include the preliminary notice language in your proposal?\ Regardless, it is better practice to use the state-specific form and properly serve it (certified mail, registered mail, overnight delivery). It is theoretically possible to hand-deliver a preliminary notice if your proposal is similarly hand-delivered, but there are proof issues with this method. The owner, lender (if any), and direct contractor (if not you) must always at least be properly served with the preliminary notice. Best, Chris
