In order to make a claim on a bond, as a subcontractor, you generally have to have served a notice to contractor within 45 days of first furnishing work on the project and then you have 90 days from the date you last furnished work on the project to file a claim against the bond. If you are in privity with the owner, then you may not have been required to serve the intial notice. You should contact an attorney to discuss your specific situation and determine what rights you have against the bond and the timing of them. Feel free to reach out if you have any other questions.
