Are subcontractors required to apply for a license to work in GA if we are hired out by a General Contractor?

We are a small, growing painting company from Kennesaw, GA. We were told about a General Contractor (Graphite Construction) who was hiring painters to work on some residential new home projects in Atlanta, owned by Brock Built construction. We interviewed with them and agreed to be paid a daily labor rate of $1200 per day for 6 days. (which we are now currently in the process of going to small claims court to recover payment) We are insured and have an LLC, but no business license yet. I am researching if we are required to hold one, and if so, is it state, county where we live, or county where we are working? I also sent an intent to lien to the builder, since the GC refuses to pay.

If I am correctly understanding your question, you are asking whether you are required to hold a business license, correct? In Cobb County, ou are required to hold a business license. See link. https://www.cobbcounty.org/community-development/business-license/obtain-business-license

You are required to hold a business license where your business is located. So you should be licensed by Cobb County. As I understand it, your failure to be licensed in Cobb County would not be a defense to the lawsuit you are pursuing, but is strictly a matter between you and the County. However, you certainly should apply for the license and make the yearly payment. Since you are an LLC, you need to make sure you have paid your annual renewal with the Secretary of State and are in good standing.
