Am I eligable to put a claim on a construction bond without a contract for the job?

New York

I wired a small window installation for a contractor at a school. I refused the contract and asked to be excused from the project, the contractor said to do the job without a contract. The ladder slipped out from under me due to the contractors neglect, and fractured my wrist. After completion the contractor refuses to pay unless I sign a release excusing him from "all" liability. Can I put a claim on the construction bond? rpiterniak@yahoo.com

It depends on the terms of the payment bond, and whether such a bond claim would be timely.
