About bonding around liens and public access to subs that also filed liens

New JerseyBonding Off Lien

Can the GC or Owner bond around the lien we have filed in New Jersey. If they can and do how are we informed of this happening? Also, is there a way for me to find out what other subcontractors have filed liens on this job?

Yes, New Jersey owners and GCs are entitled to bond off mechanics liens filed against their project. Under § 2A: 44A-33(3) of New Jersey's mechanics lien statute, the lien claimant must be mailed notice before the lien is bonded off that the owner intends to bond off the mechanics lien. But, beyond that, I'm not sure that additional notice to the claimant is required. Though, searching the property record and/or contacting the recorder's office for updates regularly might be a good way to stay on top of things. Plus, searching the record or contacting the recorder is also probably the best way to see if other liens have been filed on the project.
