What happens if the NOC that was filed with the county and notarized was not signed by the owner of the property and was a forged signature?

The signature on any Notice of Commencement will generally be deemed legitimate unless facts are presented to establish otherwise. In this particular case, the property owner would bear the burden of establishing that the signature on the NOC was not his/hers. Additionally, it would be advisable to contact the notary public who notarized the signature to inquire whether he or she verified the identity of the person who actually signed the form. It is likely that a lawsuit would need to be filed before you could compel the notary to give a statement in this regard. To the extent that the signature can be established as not being legitimate, then there would be grounds on which to challenge its validity.
