A contractor put a lien on my property but was paid $14,800 for 2 1/2 days work. I fired him no workers comp he put a le

The person who came to give a quote was not the contractor. He was working under his license I later found out. He was given $14,800 but worked 2 1/2 days total. I fired him because he gave false info about his workers compensation coverage. He was not covered. I gave him until the end of the day to get covered. He didn’t. He took my $14,800 and would not return it. He put a lien of $15,800 on my home. In California he has 7 more days to sue me. What should I do to challenge him. His work was shoddy and sloppy. He gave a quote that was really high because he said his workers compensation was expensive. The real contractor whom I’ve never met, text me and said to let him get workers comp but the quote would go up because of him having to obtain this coverage. He refused to get permits and would not return my money. He bought $1,800 in materials but bought enough plumbing materials for 12 houses. I have pictures and proof of all information mentioned. Can you give me direction as I don’t have the funds to move forward with the project.

If the contractor in question was not properly licensed at any point during the work then under B&P section 7031(a) he is not eligible to record a lien or pursue any legal action against you whatsoever for his work. Under B&P section 7031(b) you may also be entitled to bring an action against the contractor for disgorgement all amounts paid. Your best options likely will be to pursue the contractor's license bond and file a complaint with the CSLB.

Thank you Peter! I did file a complaint with CSLB and filed a claim on his Bond as well. I’m wondering if I should file suit against him or wait to see if CSLB will act. I recently received notice that they are both being investigated. Small claims would only be $5,000. With that said is there any other options I could take to move my project forward. Without these funds he took I can’t finish my home.
