Good morning I am hoping you can answer some questions for us regarding an issue we are having with being paid for a completed roofing project. This our first encounter with this type of situation. We filed a mechanics lien with Humboldt County, it was recorded and returned w/o any indication that it was rejected or not valid, we are unsure what to do next since half the information I am finding states that the Lien would not be valid w/o preliminary notice being filed and delivered to customer/property owner within 20 days of starting a project, we were unaware of this. My husband has been in the roofing business for over 20 years and has never known of any preliminary notice having to be filed for each project. We have also spoken with others who have had contacting projects done through various contractors and have never received a preliminary notice. We do include in the estimate a "Notice to Owner that informs customers of the mechanics lien if n the event that payment is not received and/or being disputed. Is this "Notice to Owner" document enough. And if not what do we do now? How do we collect payment for work that is completed and owner is refusing to pay due to charges for additional work that he authorize and disputing amended warranty for specific areas where owner refused to authorize work to be done. We received payment on this account and found the check was dated in April. The customer withheld the money due to some punch list repairs that is the purpose for holding back retention. Hi, I filed a mechanical lien back in February, about 3 weeks ago a rep from the owner's project contact me and said that they already paid in full the project to the GC, the GC said the owner owes them money, the lienis for +11k the owner offer us to pay $5k in exchange for the removal of the lien, and they said to try to collect the rest from the GC, but we told them no. How can we proceed to collect our money? How long should be wait untill we receive our money? We know that the GC closed the company and he opened a new one, another subcontractor that worked on the same project found out the new company and contacted the GC, but the GC told him that he wants to be sued to go bankrupt and not have to pay us. If the Owner is saying the true and they already paid the GC it will be unfair for them to double pay for the project, but it is also unfair for us being a very small company not being paid, $11k might not be too much, but for us it is a lot, we still owe material money from this project and we struggle a lot because of this since October. I have a general contractor suing me for construction delays. Most of the delays was caused by a third party that shut down all construction that no one had a clue would happen. I bought the property on a 2.5 acre lot, I bought almost an acre. The owner of the rest of the property had to meet certain county and city requirement's to make his property compliant, there were no sewer or water on the property other than septic tanks and well water. For him to become compliant bids had to be taken and the public utilities had to be laid out. This took almost four months to accomplish, my job sat idle in that time. I kept asking the general contractor why he hasn't shut down, he said he didn't want to lay off his men, thus using my jobsite as a sort of piggy bank. We never sat down to discuss the delays, they went straight for the lien and lawsuit, they promised me a discussion. The general contractor then told me that he heard the owner of the property surrounding mine had second thoughts and was delaying everything to make me go bankrupt to where he could repurchase the land back with my building on it. If this information is true I could have gotten to the bottom of the delays, fixed them and would have gotten my business open months sooner. He withheld that information costing me a lot of money.
