I'm a sub working on a Nat'l Guard base, for a large GC in NC. Other subs are having problems with the GC, both getting paid and cooperation. They've left the site multiple times. We are about to start on-site, but it's delayed due to the site is not ready as the GC stated, and now have material stored on site. We've been paid some of the contract for past efforts/matl,, but not all. We've sent the Prelim Notice of Miller act previously and would like to send the Intent letter as we've no faith in the performance of the GC. Hi! I finished a job in January and the customer is not paying the retainage. I know there are different rules with retainage and would really like to file a lien. I did send an intent to lien on this job, but not the actual lien. Can you tell me what steps I can take and if I can still file the lien on this job?

I filled a lien. The house was sold and I was harassed by a lawyer to cancel the lien. He told me he wanted an address so that he could pay the lien. When I offered a routing number he said that I was being sued unless I lifted the lien. No bond had been paid, I'm uncertain how the property was sold. I am the defendant in a lawsuit now and have not pushed to enforce the lien. My lawyer has told me that when the lawsuit was filed against me for the lien I no longer needed to enforce the lien. My deadline is coming up soon to enforce the lien or have it dismissed per KY statute.
Do I need to enforce the lien or is my counterclaim and defending this lawsuit the same as enforcing the lien?...Read More

I am building a new house and my contract calls out a hot roof, two zone heat and the placement of the heating system in the basement. I am not getting a Hot Roof, only getting single zone heat and the heating system was placed into the attic.
