Hi. I am writing as a homeowner looking to get some home improvement work done (previously hardwood floors, now carpet installation). Maybe it's because I'm not a native Oregonian, but I'm feeling uneasy about contractors wanting me to sign the Oregon Lien Rights document. I'm happy to make a commitment to pay the contractor, but the document seems to indicate that a lien could be placed on my property by any subcontractors or suppliers the contractor fails to pay or has a dispute with. Maybe I'm misunderstanding it, but it seems to put a lot of liability on the homeowner, to the point that I'm uneasy moving forward with projects. I've spoken with different neighbors about this and some seem to think I shouldn't worry about it, whereas others say they've never been asked to sign this document. I hired a contractor to replace an old detached garage a year and a half ago. The permit came through in March of this year, no doubt delayed due to coronavirus. The contractor moved out of state but assured me that he would find local people to complete the job. He has sent out three guys since March and none of them want to deal with him because he's out of state. The problem is that in April he told me that he would be hiring one of them and wanted me to send him money so he could pay the guy. Then the guy didn't work out so my contractor has my $20K. Since then he's sent out two other guys to complete the work and they didn't work out either. But since each guy does a few hours work, I feel like I can't claim breach of contract. The other problem is that before he moved out of state, last July, my contractor tore down the old garage and dug the hole for a new foundation (because the original foundation was over 100 years old and broken/buckled) so I've had a big hole in my backyard for a year now. I borrowed a lot of money to pay for it when he first took the job and he promised to have it done last year (promise not in writing) so I was planning on refinancing when the job was finished in order to pay for everything. But now I have a ton of debt and no garage and feel contractually tied to this guy. If I fire him I will probably never get my $20K back. The job was bid at $105K and I've paid him $37K for completed work, plus the $20K for wages to workers that didn't take the job. I'm not sure what to do. ...Read More

Im a Lawn and Landscaping company owner, and recently had a customer accept my bid for her property. So i collected half down for materials like normal and got the materials, Completed the job, And everything in the scope of work, And the customer is now demanding extra materials not listed in the contract. Now she is refusing to pay for the completed work! I believe since she is doing this that she had no intent to pay for the labor when the job is completed meaning the other 50% down, My question is; Is this considered "Theft of services" in Iowa? and can i just file a report at the local police department for it?...Read More
