I was hired by a contractor to do a house remodel there wasn’t a contract made I finished the Job I had charged $13,816 total I received $10,506 already I sent final invoice to receive the rest of my payment this guy refuses to pay me I’m i able to file a mechanical lien I’m in the state of Oklahoma. Our contractor did a lump-sum bid on retiling the shower (76 square feet) that is in our walk-out basement. We said we would buy all material, but not tools. Basically, he bid on his labor cost, The contractor is installing new DryBoard/ tile shower back board. When removing the tiles on two of the walls, he found that the walls were cement block. He spent quite a bit of time removing the tiles on those two walls, and then getting the new dry board to lay flat on the cement block. Should he expect more money from us to cover this unforeseen aspect? I know for sure that he is a beginning contractor, but his price was very competitive with an established contractor; there was only a $200 difference between the two. I'm wondering if the established, more experienced contractor would have asked us for more money, or if because of his experience, would not have let the cement walls delay him. Is this just part of the "risk" when bidding by lump-sum and just part of the learning process for the newer contractor? I need some advice on how to proceed, but really, how to feel about the pricing: do I compensate him for his extra time?...Read More

We have called, emailed, and texted trying to make payment arrangements with no response. We have also found out that his business is not legitimate. I am a safe and vault technician of 10 years. A new homeowner contacted me to unlock a broken safe that was in her house and bolted to the floor and needed it to be unlocked in order to get it move out. Upon completing the job I was requested to do and myself requesting payment upon completion the homeowner told me someone else will be covering her bill. This other person will not pay her bill and I have asked the lady who hired me who is the homeowners and owner of the locked safe to pay. I was told that I was able to unlock the safe so quickly I made it look easy and she does not want to pay $345 I quoted to unlock it. I believe that they never had a plan on paying for the work from the very beginning. We finished a project (Monsaraz Inn) and we submitted the invoice for 10% retainage at May-2021. I was following with GC on the invoice and we were notified by email that they are negotiating with client and the work on the project was completed on June 23, 2021. We released the Notice of intent to lien by August 16. On August 20, we received a back charge for LD on this project by GC about $84k. I just wanted to add the following information: 1. No where in the Contract agreement is there any notice of Liquidated damages. And a cost which goes with it. 2. The Back Charge has no where indicted in the months and months of emails that we are causing a delay to the project. In addition, nowhere does it tell us we are being charged a delay cost for the day indicated with the exception of the Change order we just received.
