We did engineering work for the owner of a residence and sent an invoice on 12/23/2020. No one could get ahold of the client for months including the architect. We finally found a family member and found out our client had passed away in Feb 2021. so if there is a properly filed mechanics lien on my property and I have negotiated with the contractor to file a release of the lien for a final one time payment, do I use the California Unconditional Waiver form? And if so does the contractor sign this first then go to the county recorders office and file the release of lien? what if he doesn't and has cashed my check? does he usually wait for the check to clear then files the release of lien? who pays for the court filing of the release of lien?...Read More

Roofing Contractor placed a lien against our property while waiting for the insurance check to arrive. An insurance check that was delayed because of the numerous times that the roofing contractor kept submitting more and more claims trying to squeeze everything they could out my insurance company. For four months the roofer went back an forth with the insurance company for more and more and more. Finally on August 9, 2021 a settlement was reached between the Insurance company and the roofing contractor. Then we had to wait for the check to arrive in the mail....10 days later, Saturday, August 19th, 2021. However, we left on vacation on Friday, August 18, and received our collected mail upon our return home, Sunday, August 22, 2021. Today, August 23, we received an email from our roofing contractor that they had placed a lien on our property. Meanwhile the check from the insurance company still has to go to our mortgage holder for endorsement and return to us to deposit and write a check directly to roofer. How is this even possible. There roofer delayed his own payment by his need for a bigger payoff. Initially, we were quoted a roof replacement cost of just over $12K cash, no insurance. The total payouts between the insurance company and my out-of-pocket deductible is a grand total of +$36K - 3 times the original offer. House built in 1957, footprint about 1500 Sq.Ft. which includes the two car garage. $36K can't be right for a home in one of the less expensive states in America to live in. Was this lien that was filed premature? Was it a frivolous waste of the courts time? How will this effect my credit rating? Do I have recourse to contest their filing?...Read More

Builder gave us a price when we signed the contract of $200,000. We gave our earnest money, choose house colors and details and we were promise the house of our dreams. After 2 weeks without an update, I called the sales person and he advised me that corporate had not accepted the rate they had given us. That if we really wanted the house to be build and for us we need it to sign a new contract for $213,000. If not, that they would cancel our contract, which was already at the title company by the time, and give us our money back. I told them that of course I was not going to accept nor sign a cancellation because I was not cancelling anything. At the end, they cancelled on their own and just told me to pick up the earnest money and that our house project was cancelled. We were so devastated, we had to renew our contract again at the apartments, had to look for a new builder and we just felt really discriminated because we were not able to get the house at the price they gave us since it was the top amount the lender had given us. ...Read More

On April 2019 my company, Granados Handyman and Construction LLC, began work at Iglesia Santidad Jesus Viene Pronto under a contract signed by Pastor Felix. The contract required several down payments to made throughout the course of the work. As the work progressed we had only received portions of the amounts that were due. There were several changes of order throughout the course of the which inevitably surpassed the original budget set in the contract. The pandemic ended all work for the time being and money was still owed. Throughout that time and after we had not heard back from the church to address their outstanding balance. We reached out once again in an attempt to solve this issue within ourselves and agreed to have a sit-down meeting to review all invoices that had been provided to them. Part of the outstanding balance had been paid in cash that day, but the remainder had been held back until we agreed to continue working. As we continued working, there were no attempts to pay the money owed. We later requested that payment of all the money due up to date to be made in order to proceed with the work. Later, we came to find out that work continued at the building under our company’s building permit without any supervision or approval from me putting my license at stake. We were left with no option but pull my license and inform the Lynn City Hall that we were no longer performing any work at that location. As time went on, we still had not received any further payments for the work completed at the building for more than a year. I need to file a lien notice. We are a parts supplier providing to another supplier, who sold to a GC that is installing a dock for an OA. The parts seem to be at the marina location in a parking lot. The state the part's are in is Ohio, and the supplier we sold them too is located in Indiana. Who does the lien get filed with?
