I am a 2nd tier sub contractor on a Public High School project in Texas. The sub contractor has not paid us according to our agreement. We have added late charges per our agreement. We filed our public monthly notices. The general contractor has issued a joint check with a partial lien release. They did not include the service fees stating that was not their problem. I have a customer that we did an emergency roof tarp repair for. The client had a roofer to do the build back. We ended up charging $1.00/sf of the tarp we did. The client ended up paying and then emailed us a couple days later saying the roofer they are using is telling us we over charged the client which we didnt. They are now putting bad reviews on social media and google review. We sent a cease and desist letter and they didnt stop and still slandering our name. I have a contractor who was paid for remediation following Uri back in March. It took him 5 months to provide my insurance company with an estimate for remediation and 6 for the whole job. During the last 6 months my house has been unliveable, so I've spent 7 months in a hotel due to his less that quality and not to code work. I hire a handy man to renovate my bathroom and I gave him some upfront money. Now he finish the job with several flaws, damage to my bathroom floor and some thing he did not replace like we deal on the verbal contract. I told him to come to my house sitting down to discuss and I would like to have some money back before I pay my last part of the deal. I am a subcontractor who worked for 8 months on several properties for an owner/realtor. There was never a contract. I sent in invoices for each property and he showed up once a week and had me sign a partial check and handed me cash. I did sign a W9 Tax form in the beginning. We have been working on a project for about 9 months now. The bulk of our work is complete and most of our labor has been done but we need a part to complete. The part has been delayed for some time due to the manufactures delays because of Covid, etc. The customer has been kept aware of the parts status and has been in agreement that we will finish as soon as we receive part. We have been working in house to to obtain part by regularly checking with supplier on status and have updated customer within the last 30 days. We have also been in contact with and updated another contractor that was to be involved on the completion of the project. We may not have actually been to the worksite in over 90 days but certainly have continued effort and were ready to complete project when part was delivered. The customer notified us a few days ago by email that he wants to cancel the project stating that his permits were denied on his farm project where we did the work. He is not willing to pay us for the labor that has already been done. Do we still have legal lien rights? Thankyou...Read More

We had an oral agreement, backed by many emails to and from, with a contractor who was unable to perform the work he promised to do. We fired him and he left the job on April 30, 2021. He had no contact with the owner of the house, who is my daughter, until she sent him 2 payments on June 1, 2021. On August 16, 2021, a letter and copy of a Mechanics Lien was sent to our address, which is not my daughter's address. There was no "notice of intent to file lien" sent to anyone. We sent a very detailed response to the contractor's lawyer telling him why we do not owe the contractor anything. We already paid him $12,815.58. The contractor sent an invoice on May 19, 2021 asking for payment for punch-list items that were actually done by the contractor who replaced him and 2 other vendors. He gave credit for $12,000.00 even though we sent receipts for the $12,815.58 that he was already paid. We also sent copies of the proposal from the contractor who replaced him, showing the work the new contractor performed - the same work that the claimant contractor wants to be paid for. What do I need to do to file a motion to vacate his frivolous mechanic's lien in Lake County, IL? My daughter's house is now on the market for sale.
