We are a commercial electrical contractor and were hired by a general contractor to perform the work on a project located on a military base. So the project is government funded. Well the GC has informed us that the electrical scope of work was pulled from the contract and so basically we were not going to be doing the work after all. We had ordered some light fixtures and had them stored at our vendor's warehouse location for that job. They are still in there today. When I asked for payment for the invoices that covered those stored materials the GC informed me that they were not going to be sending payment. My vendor who we use on the daily is asking for payment but we have not been paid and looks like we won't be. The materials are non refundable and not returnable either. What are my options to receive payment?...Read More

Hello, I need help finding a lawyer in Dupage County to represent us in small claims court. I have reached out to no less than five firms asking if they handle small claims collection representation for an incorporated construction company, and not one has responded. We have signed contracts with each of the three customers that owe us each approximately $6000. I figure finding a firm located in DuPage County, where our business is located, would be more appealing to the firm due to travel time. Are you able to provide us with a Dupage County lawyer that takes on small claims cases for incorporated contractors? Thank you for any help you can provide. ...Read More

Hi there! I completed work on a home in la jolla Ca for inside and out window cleaning. The home owner is now reporting that there are scratches on 6 Panes of glass and is refusing to pay. The windows in question were cleaned the same way every other window in the house was cleaned and the home owner was informed of the equipment we would be using to clean the windows. I told the home owner that he should contact the window installers because it looks like the window was installed backwards and the low e coating is on the outside. The home owner is insisting on running my insurance even though I explained to him that the damage was not caused by faulty workmanship. I already filed a 20 day preliminary notice for a lien but I want to know if he would have a case if he chose to take me to court for damages and what I should do to protect my company....Read More

My client is being very unreasonable, very nit picky, have been doing extra work that she is asking for, I’ve been trying to work with her but she now refuses to pay and I can’t keep going with no pay for my workers. Unfortunately the contract states that the remaining balance is due at end of project, but with all the unrealistic redos she’s been asking of us, we can’t continue. ...Read More

We will be working on a hotel on a bulk room basis, so 20 or so rooms to each invoice, with each invoice following up after closing out the previous 20. Should we send a preliminary notice for each invoice or will one preliminary notice cover the entire length of the job? Is this altered if we provide a final lien waiver after each invoice is completed?...Read More

I performed work as a laborer for a homeowner who owns three personal properties. The work consisted of painting the interior and exterior of the homes and property management which consisted of lawn mowing, minor repairs, etc. while the homeowner was out of town for 4 months. I began doing this work approximately 2 years ago, and obtained a written agreement from the homeowner that I would do all the labor on is properties at a heavily discounted rate. The discounted rate was agreed to because the agreement called for me profiting from the eventual sales of the properties. The amount owed to me for property management fees are approximately $3,900.00 and the approximate profit coming to me from the eventual sales of the three properties is between $50,000 to $60,000. The homeowner is now telling me that he will not honor the original written agreement and is refusing to pay me the property management fees and will not pay me my share of the profit upon the sale of the three properties. ...Read More
