I hired contractor as a concrete sub on a project. He installed 90% of the work and I paid him for the project (approximately $6500.00). Unfortunately, the concrete didn't pass inspection and had to be removed. I tried a dozen times to reach him to correct the work and even sent a 24 hour notice to comply. All communications were ignored and I had to remove the faulty work at my expense. After I removed the concrete, the GC i was working for decided to take the concrete over and complete it themselves. Within 24 hours of them informing me they will be handling the concrete, my contract was terminated due to the concrete subs inability to correct the work. Do I have a good case to go after the concrete sub for the money that was paid to him for the faulty work, the cost to remove the faulty work and the damages I incurred from being terminated due to his poor craftmanship?...Read More

An ex-vendor provided security services to our property for 2-3 years. In March or April of this year, they came to the conclusion they billed us incorrectly for virtually all of 2020 and sent us a bill for $8k to make up for their apparent error. After requesting proof of the incorrect billing to support their case – they never provided this. Furthermore, we asked for a copy of the contract that says they have the right to do this and can place a lien on our property for non-payment. To no surprise, they have not produced a contract. We ended up terminating our arrangements with them. Now…they are threatening placing a lien on the property through Level Set We have never received a Pre lien notice ...Read More

A bonding company has filed an interpleader action and I am one of the multiple (5 so far) defendants in that action. You said that I need to file a timely answer to the interpleader action with the Court. Since the bond is small and is not even enough to cover a single claim, I'm trying to find out if hiring a lawyer or participating in the claim is practical. The bond company also said we could do Stipulation and order in lieu of Interpleader complain. Is there a charge too for preparing Stipulation and order or the bond company lawyer will do that for all the claimants? ...Read More

If there is a prevailing wage increase in the middle of a lump sum public agency construction contract, is the public agency responsible to pay change orders to the contractors for the increased wages or are the wages "locked" in at the beginning of the contract such that the contractors only have to pay the wages per the effective date of the contract?...Read More

i used level set to send a preliminary letter on 914 and again on 9/15 because i learned the person who hired me was actually a subcontractor so i needed to add the actual GC on the letter. on here is says the letter was sent on 9/17 and i received payment from the person who hired me on 9/17 in the afternoon about 5:15pm. i did sign a waiver for him where i waived any lien rights. he sent e a picture of the letter today and said i needed to take care of this or he would be taking the letter to his lawyer tomorrow morning. From what i know the letter is only a notice to the parties letting them know i have yet to be paid. i did let the homeowner and GC know i received payment that same day. is there anything else i need to do on here or legal wise for this? ...Read More
