In Ohio, if the General Contractor has a direct executed contract with the Owner -does the General Contractor have to send out a "Notice of Furnishings" or is the Notice of Furnishings in Ohio only for Subcontractors and Material Suppliers who do not have a "direct Contract" with the Owner. The General Contractor is using subcontractors on the Project. We know "when" there is "no" Notice of Commencement filed with the County, no one has to send out a "Notice of Furnishings" to preserve Lien rights in Ohio. It seems everything is silent on any specific process for the General Contractor to follow other than for the General Contractor to file a lien if he does not get paid without anything being said about doing anything before the lien is filed to preserve the General Contractor's lien rights. ...Read More

I requested a preliminary notice to be sent out to a subcontractor who hired me on a residential job. I requested this letter on September 15. Preshipment info was sent to USPS on and arrived at USPS on 9/20. I was paid at about 5:15pm on 9/17. I signed a document that states I release any mechanical lien rights, stop notices, or bond right. The subcontractor received this letter yesterday and said I needed to take care of this. I told him those letters were sent before I received payment and that because it was a preliminary letter I didn’t need to take any more action other than not send any more out. He said that I needed to call level said and make sure everything was closed down because he had called and they had told him it was not. This was yesterday at about 7 PM so obviously no way for me to contact anyone since you guys close at 6 PM. This morning I contacted someone I had archive the jobs and just said I had been paid so please be sure no other notices are sent out. The subcontractor said he turned over the notices to his attorney and that I would be hearing from him. My question is, could I have any issues with the fact that the letter that I requested be sent out on the 15th was actually mailed until the 20th even though USPS received the information on the 17th, the same day I signed the document. On the affidavit of delivery it states letter was mailed out 9/17. When I spoke to the representative earlier she did create a retraction letter but I did ask her not to send it I just wanted to have the PDF in case I needed to send that out but I’m wondering what my best option is....Read More

My company did a residential rehab project in Orangeburg SC, the client asked that the original contract be revised due to a misunderstanding ( she suggested that I start working in both bathrooms at the same time. I said no I'm not doing that bathroom now, I've come to learn that she thought I meant I was not going to do it at all. When I actually meant it is not a good practice to have both bathrooms inoperable at the same time.) she had no input on what she'd like the revised contract to state. My changes were how the monies were to be paid going forward, she refused to sign the contract or offer any suggestions to try reach an agreement. My husband and I are painting subcontractors and contracted to paint a student housing apt complex from a company called turn University. To keep this on the shorter side I’ll skip the stories that were throwing up some red flags but ultimately after a couple of unsuccessful attempts to fire us we were down to a couple more units to paint and minor touch ups and we were told we were fired. We called the police and told them that we were wrongfully being fired and we were pretty sure this turn University was a fraudulent company. Started investigating and sure enough they were a fake company. Another Craigslist Scam. I found out the name of the company that hired turn University to do the paintwork cleaning and carpet cleaning for their turn . I managed to find the president of the company and filled him in. He had someone on a plane from Colorado to the job site in North Carolina the next morning. He had the “regional director” for turn University cornered and the scam was exposed and jobsite shut down. We have lots of evidence and even a 15 min confessional from turn’s regional director. We shared all our findings and even how the cleaning crew is involved planning on taking a lot of money from them. We have lots of correspondence with this company and they have stated they have all intentions of getting us paid but since we contracted the work with “turn” it is throwing up many challenges and has to go the legal route. I sent a noi but they did not want to settle up with us leaving us to believe that perhaps they do not own the property so now I’m working on finding that out. This group ends up being the moorish sovereign citizens movement which is classified as a terroist group here in the States with roughly 7000 members. We really need some advice and some direction as where to turn on getting our money. This has put us in a very bad situation. Any advice on this will be appreciated more than you will ever know . I have completed a job for a GC which was slated to be completed by Feb of this year. Due to this they requested us to do multiple move ons, site visits and meetings over the course of several months. All during this time prices hyper inflated on materials which they said they were unaware of. Also during this delay other projects started and the majority of my man power was used on this. After months of calling they finally were ready. I was only able to provide two techs to the job and agreed for one week of suplemental labor provided by the GC at inflated costs. the end of that week I told them i would provide more man power and would not need their laborers. The GC still had laborers on site and are back charging me for changes out of my scope. I refused to sign the change order explaining that the following week I told them they were not needed. I also stated that the changes in the civil were not part of my scope. The owner of the GC is forcing me to sign and saying he is going to add other charges to this because I delayed his job. I will not talk to them on the phone anymore due to their erratic story changes and trying to keep it all docuemeneted on emails. This is not a large project- base contact is 35k and they are trying to deduct over 11k out of my contract and telling me more is to come. Do i even have a leg to stand on?...Read More

I'm a Hunter Douglas window fashion representative. I've installed the 16 shades that were custom ordered and customer refused to pay balance at time of installation. She contacted me a week later complaining shades where fraying on some of custom shade edges. I worked with Holli Gabler for 4 months to offer her replacement solutions at no additional cost to her. She still has refused to pay and after placing lean she has emailed me saying she "I should have let it go and now she will sue me to remove the lien". What should I do at this point? ...Read More

We were a GC on a big job in Texas. Our lien expiration is 10/15/21. We only have 1.8 M invoiced so far, can I file a lien for that amount and when we bill the balance which will be another 1.8 M amend the lien to reflect the actual dollar amount even if the original lien expiration was 10/15/21 ? I am a property owner, with a solar panel lease on the roof. Panels are installed 8 years ago. Because of a recent roof leak, I came to discover a few things. According to 3rd party roof/solar contractors, the set of panels installed was not up to code, and it should of never been installed. Because my roof had no plywood or OSB layer, there was anything to secure the panels. And because of the installation on wood shingles, the roof is leaking because of that. And I can't patch the leak, have to replace the entire roof now. So I was advised to check with building and safety for proper paperwork. And to my amaze, I learned that safety inspection was not done, and the installation permits all have expired, and I was advised by building and safety to contact service provider. SunPower tells me to contat authorized dealer, dealer says they can't help and to call SunPower. So now i am stuck in a loop. Can anyone help me?...Read More
