I was hired by the owner to do some siding work on his property. He is the builder/General Contractor, as well as the owner. After many disagreements on site, the owner and I agreed to part ways. He was going to pay me for materials and work performed to date. Now he is not getting back to me. I thought with the owner being the general contractor, you could still file a lien without the pre-lien notice? If not, is my best bet to start a law suit?...Read More

Hello I am a designer/draftsman for a large home in Texas (I am not an Architect and do not claim to be). The client used an LLC to engage our services via written agreement and has not paid an invoice rendered for over 6 weeks. The agreement was a specific date based payment plan over several months and not tied to outcomes as the client's business manager has a history of frustrating the delivery of outcomes. The recommendations called for in the agreement were provided however the client has ignored them. Do I have the right to place a mechanics lien against the property the design work applies to? Hello— I recently received a certified letter from 2 men stating they would be filing a mechanics lien against my property. These men are apparently ex-employees of a company I hired to do foundation repair on my house. They are claiming the company didn’t pay them commissions while they worked for this company. I have paid the foundation repair company in full for their work. I have no idea what these men are talking about. These men did no foundation work on my property as employees of this company or otherwise. I called the company and was told to ignore the letter- these men can’t file a lien. Can they file a mechanics lien against my property? Will the state of California issue the lien? This seems to be a fraudulent attempt to extort money from me, but I am concerned I should do something more than “ignore” them. Thank you for any advice you can give me....Read More
