Great article. I'd like to suggest you add to Dispute resolution method - location of venue and laws governing. I'm in Texas - I regularly argue venue - my most successful argument is to change it to "county where project is located". I have also had contracts that state the governing laws are of the state of New Jersey or California. Once you've agreed to a different venue you're looking at crazy additional costs for travel, new attorneys etc. (but, y'all know that). Thanks again. I just received a claim of lien on my property. There are many things wrong with this. The lawn company was supposed to perform the work in March 2021 and never showed. A couple weeks into April we came home and the work was done, being generous lets say it was April 15 (most likely a few days before). I thought their communication sucked but the work was done. I called them numerous times between April and now asking for a bill or how to pay. I always got a voicemail never got response. I have never seen a bill or a phone call from them, totally willing to pay for the service but don't know how without a bill or address to mail a check etc. Their website just has phone number and email. Today I received the claim of lien. The claim of lien still doesn't tell me where to pay. I called and left a message again today. I then looked up rules and if I'm correct he would have had to complete the work on June 25th or later to be able to file this lien. Is it best to try and dispute this now or should I wait to see if he sues me? I'm beyond mad. I would have used him all summer but he was horrible. I'm literally paying a different law company weekly - only say that to reference the small couple hundred amount is not worth this darn headache....Read More

I am a General Contractor hired by a Homeowners Association to do work on 4 different decks in a community. The HOA has a property management company and also a separate Construction Manager for this project. The invoice gets sent to the CM who then forwards to the property management company to cut the check from the HOA checking account. Who would be considered the property owner and who do I need to send the preliminary notice to? What are the roles of the HOA, Prop Management company, and CM?...Read More

Summary: We were hired by a contractor to build a glass spiral staircase; glass railings and treads. Contractor paid our 50% deposit and then defaulted on the balance. Notice of Intent and subsequent Mechanics Lien was filed 17 months ago on a homeowner where our work was done. We asked our attorney to file against the contractor. A judgment was ordered against the contractor for the full amount. The contractor said that the homeowners never paid him the full balance. But that took 17 months for him to tell us? Now, that the contractor is about to lose his license he wants to pay us, although over the next 12 months. Since our original lien was not perfected by us filing a suit against the homeowner, I do not believe our lien is valid. I am certain that the homeowners’ attorneys will figure that out. I would like to know if there is a way to enforce our original lien or file a new lien because we think that the homeowner did not actually pay the contractor the full amount and possibly, we can have the homeowner pay us our balance....Read More

I was hired by a guy I called my friend. He was hired by a disaster restoration company. He wouldnt tell me what company, or which insurance company. I performed services and provided materials for plumbing repairs. When I gave him the invoice he began to question everything on it. He also became verbally abusive. He told me he required all of my receipts for materials. I do have mark up on my parts. I also added profit and overhead to the bill. I can’t seem to get him to call me back. I performed this work on time and materials. No upfront contract. I also have been made aware that the house has asbestos in the mud of the walls and I did cut holes which has exposed me. We are a subcontractor. The customer has not paid for two invoices, but all of the others were paid for. Due to Covid-19 we could not walk in to file the lien, and because we rarely file liens, we did not know that is how San Bernardino County was handling their lien filing. (By appointment only). We had to find an approved company, to do it over the internet, to expedite this, which is how we found the Levelset.com company. This webpage says we filed late. But our documents went to Levelset the same day we signed up. They took a couple of days to mail out the lien for recording. It has a date of 08/31/2021 (stamped). Our last day on the job was, 05/26/2021. (5 +30+31+19 = 85 days. We should have had 5 day grace period still available to file....Read More
