I subcontracted to an HCR Mail Carrier to cover her delivery route via verbal agreement for $100 per day. I have since found out that the average rate is $250 per day. But that is really irrelevant. She has since refused to pay the full amount she owes me saying that her total rate is $100 per day and that she did not say that is what she would pay me specifically. So because they had to bring in other mail carriers to train me because of her sudden accident prevented her from doing so; I would have to split that $100 per day with the people that trained me. That it is not her responsibility to pay them above and beyond the $100 per day that she agreed to pay me. A complex question. For a new building in Sussex county that is complete on construction and sale to unit owners. It appears that the developer has stacked the condo association board with their general council and the chair of the local zoning committee (the obvious conflict is not the primary issue). What is at issue is that the developer is trying to get out from the building with several significant issues that will likely run in to the 7figures to repair. Their exit is a blatant attempt to push off the repairs to the association/owner membership. 1) is there recourse for by he owner association 2) would the construction be under bond and can local authority assist in holding the developer responsible 3) where would one file a complaint (city council, county revenue departments, states attorneys Any insight or direction to the correct title/code sections would be helpful. We hired a contractor to erect a steel building that we bought and paid for. We paid the contractor in full upon what he claimed was completion and have copies of all cancelled checks. We now have a mechanics lien on our property, filed by the subcontractor, because the contractor did not pay him. During all this we found that the work has not actually completed. There are bags of insulation left that need to be installed at the ends of the roofline to keep moisture, birds, animals and bugs out. an unlicensed handyman that doesn’t even have a business license was hired to paint a home, and walked off the job before finishing. He is now demanding payment for the job or he is threatening to file a lien against the property. He is not licensed for business nor is he licensed specialty contractor. We filed a lien on this project and since filing, the GC is stating that although they did receive all of the materials listed for the lien, where we delivered materials and what we are claiming as the Legal Job Address are different so our lien is invalid and we should "settle". But, is not that a common thing: Materials being delivered 'close' to the jobsite but not always AT? Our lien should be valid, correct? I am in the process of building a house on a lake and the neighbors keep complaining because they don’t like change or are jealous. Once the complaint hits the county, the county immediately places a stop work order without visiting the site going off the neighbors “photos.” We have literally done nothing wrong, have resolved 2 of the stop work orders by just having the county coming out to the site and now we’re dealing with a 3rd. These have all happened in the last 2 weeks. Is there any legal action we can take because it’s cost us thousands of dollars to have workers on site and then we call for an inspection and realize there’s a stop work order....Read More
