Essential Home Improvement,LLC PO BOX 454, Mount Pocono, PA, Residential lawsuit The following is a letter sent to the plaintiffs lawyer and gives my overview of the situation: I have received your clients claims and request for a refund of four-thousand three-hundred seventy-five dollars ($4,375). I have contacted your office multiple times to discuss this matter and have not received a response. I do not agree with this claim for the reasons listed below. Your client breached the contract by adding additional work to the original scope of the project. Drywall in living room ceiling with a 16' peak. Drywall, tape, spackle, prime and paint the entire downstairs floor, two bedrooms upstairs; this was also completed on the living room ceiling. Your client imparted changes to the existing sliding door to be relocated. They also requested two rooms to be closed or altered. Your client also changed the original paint choice from non brand specific to semi custom paint; which resulted in approximately four- hundred dollars ($400) which they did not cover. In addition, my company fronted the installation of a new 50 gallon water heater at the cost of one-thousand two- hundred dollars ($1,200.00) which was to be refunded to me by your client. Your client requested electrical modifications for lighting and fixtures which are not included in the original scope of work which cost four-hundred thirty-seven dollars ($437.00) Your client fired me without warning, on the spot, and gave my less than 24 hours to clear the project site. This action negatively impacted my work flow, schedule and payments to workers. Your clients action also potentially cost me additional work and working partnerships as this was done in the presence of outside workers and an outside company. I'm willing to forgo legal proceedings if your client agrees to a settlement of two- thousand three-hundred thirty-eight dollars ($2,338.00). I would like to resolve this matter as soon as possible. We are splitting time between two homes. We claim one home as our homestead for taxes. We had a general contractor working on a metal building on our second home (25-60% residence over the past year). We do not have a written contract. He is threatening to put a lien on our property because we are terminating our working relationship due to his refusal to take our calls, answer our texts, or come to our project site. We are trying to compromise with him based on our out-of-pocket costs to remedy his construction errors that do not meet code, but he will not budge. (Straight math: what he wants us to pay minus what we are having to pay other contractors to fix his errors. We had already paid in full for the part of the project that included the errors that have come up in inspections.) Let’s say a homeowner pays the original contractor in full, but said contractor failed to pay his subcontractor. You say no lien can be filed above. But could the subcontractor file a lien against the property owner anyway, even though they aren’t financial liable? Could a lien be used as a form of weaponizing the legal process to extort monetary concession from a homeowner that had already paid the original contractor in full? I’m a subcontractor in a bank financed residential project . I submitted an invoice on 10/18 that included 90% of underground waste and 50% of water. I broke down the cost on my invoice, the GC is “telling me the bank told me you’re only 5% completed”. I’m not sure how “the bank” is getting that I’m only 5% completed when I’m 100% completed on waste and 75% on water. I passed my inspections. I'm in a mess, my future hope's and My friend is just a lie. A friend of mine came to me and offered me a opportunity to start flipping houses with him and he was working on one that he could use some of my help with. I've worked for him before on his house that's how we met. I was working for someone at the time and was able to work on my time off. And I needed a place to stay, So he told me that I would be able to stay in one of the bedrooms while he and his boys will be in the rest of the house. Now that the work is almost done he has completely changed his tone and I'm afraid he's going to change course and just leave. I had a contract with a plumber for the amount not to exceed $13000 on Sep 17th (completed on Sep 22nd). In addition, I gave him permission to send the details of work to the insurance company directly and get paid from them directly. Later, on Oct 4th he emailed me an statement for the amount of $10, 000 for the total work. On Oct 13th he sent an itemized details about his work to the insurance company. He put lots of exaggerated amount of the work in his itemized and insurance paid me 14,000. After the insurance payment, he sent me another statement (on Oct 21st) with the amount of $18000. I disagreed to pay more than his first statement (10,000), and he sent me an email on Oct 27th. He accused me of cheating and told me that he would place a lien on my property if I don't pay him before Nov 2nd. At the same time, I contacted the insurance company to report them about the false data and request to send back their money until the case become clear, but they refused to take the money back. Could you please let me know if he has a right to place a lien? Is he required to send me an official notice before placing a lien? What are my options at this time? ...Read More

i am not licenced. i am a handyman. i am way past deadline because when they couldn't pay i agreed to take payments. They didn't make the payments. They recently had me come and do some punch out work and said they would pay me if i did. They didn't. Does that now count as the last day i furnished labor? My phone with pics was destroyed so i don't have pictures to show a judge but there are several people i hired to do some specialty stuff that can testify to the work that we performed. Can the court subpeona pics of the finished product? I know how sketchy this sounds. We were friends so i didnt protect myself. I thought they would pay. Their house looks fantastic. So my questions are these: ...Does doing punch out work change the last day of labor provided to that date? ...Do i have to have before and after pics or will statements from several people that worked there fly? ...Is small claims court a better way to go to get around the strict deadline rules? ...Am I wasting my time since i didn't plan ahead and just take the loss?
