Contractor built a house on my land. They subtracted money from the house cost that was never added. This figure is what the lender used to close our loan. Contractor is short $9554. I refused to pay for their mistake and I don't want to give them the C of O draw. There's fraud and many mistakes with the loan and builders. The mechanics lien should have been filed by mid September, but was done on November 30th. House was finished by June 8th....Read More

Can a minority shareholder of small family farm scorp file a lien on the land? Minority shareholder was the only on farm working, original shareholder who forwent his wages and paid land taxes and professional fees to keep from losing the land. 3rd generation shareholders recently fired him, transferred the farm bank account and the money earned from this years profits. This man is my father. He is 92 and the unthinkable has been done to him. These majority shareholders (his deceased siblings children) are planning to sell the land in the scorp. The farm corp has no other assets. I am also afraid they may try to transfer land in to another company to get my dads 22.5%...Read More

Good morning, My question is more of what are homeowner protection options in the state of florida for the below example: Company A is performing electric work at my house, and damages my sidewalk. Company A then hires Company B to repair it, and pays Company B in full. Company B subcontracts out materials to Company C through a verbal contract, but cancels with them due to monetary reasons and instead verbally subcontracts out Company D for materials and completion of the work. Company C is now filing a notice to owner for cost of unpaid materials that were ready before everything was canceled with them. What can the homeowner to protect against the lien claim? ...Read More

I filed a lien for a project. The Levelset researcher but in the wrong Property Owner. I then received threatening a letter that we, Olson Restoration would be sued if this was not handled immediately. I called and spoke with a Levelset Rep: Lillie Christie and she told me that I would have to cancel the lien and that when it was recorded - I could call back and we could file the lien correctly. Well, I called back today and it seems the lien time expired. So now I can't file a lien? This is all due to the error of Levelset. Is there anything I can do? Thanks, Nanette Martinez 303-815-5595 nmartinez@servpro1444.com ...Read More

We are the Material Supplier only. We did not file a pre-lien, because project owner information was never provided to us, and the project is not located at a specific site, but is 145+ miles of fiber optic installed underground in easements along roadways throught the Bay Area. How do I go about filing a Lien at this point? How do I find out the owner if our cusotmer will not give it to us. I have been told that it is AMAZON, but the General Contractor, Bandwidth IG says to list them as Owner and GC. Can I still file a Lien? What is a Materialmen's Lien vs a Mechanic's Lien??...Read More

We have a project in Augusta, GA. We are days away from completing our scope of work. We have around $30k in extras billed to the GC based on hourly work. Our subcontract specifies that any extra work is to be tracked daily and submitted to the Project Superintendent for verification of work. His signature is required on these daily sheets. Payment then must be approved by the PM. The Super refuses to sign any sheets. Without them, the PM has no duty to pay us for the work performed according to the wording in the subcontract. What are my options at this time?...Read More
