I like in Missouri and I have a car that we took to the dealership in which they told me that it was covered under the warranty and they could fix it. When I got a call back from them they told me that it wasn't covered what did I want to do? I asked how much was the car worth he told me $8000. The lien was for $5000 so I told them to put it back together and I will call the dealership in which I purchased the car to pick it up. Mind you these people took the whole engine apart. I called the dealershiper where i purchased the car.m and told them they could come get there car and where it was. ( I thought that was a volunteer repossession). The thing is how are they still charging me like I have the car? I looked up the car and it has more miles on them. How is that possible and why didn't I get a reposition on the car after the lien? Here is the situation
We are fully installed and currently in the PTO stage. The PTO application was submitted to the utility on 11/02 and is currently awaiting their approval. This does leave us with the chance that the utility could ask for a change to be made on site.
We have not been fully paid yet. If the notes on the processing page are correct, we have only received $36.232 and are awaiting further payment of $53.098. There was damage done to my home. A construction company had me sign a contract that allowed him to accept money directly from the Mortgage company. The company took 2 years to due the project and its still not done. In the middle of construction the Mortgage company issued a check with my name and the Contractor's name on it. The Contractor died. His company filed for Chapter 11.
What are my rights to get that check endorsed by the Bankruptcy Trustee and given to me to finish my house? It is my understanding that if there is a Mechanic's lien against the property that the money is NOT part of the bankruptcy estate and that the Trustee can simply endorse the check on behalf of the Construction company. What if there is not a mechanic's lien on the property? Does the check become part of the chapter 11 filing, and my insurance money is just mixed in with all of the other Chapter 11 unsecured creditors? Can I at least be given Priority status as a creditor? This is taking place in NJ Bankruptcy Court under chapter 11 . Can I file against his bond company? I read that I might be able to give a 30 day notice to the Construction company to force them to file a mechanics lien, is that true?

We filed a 20 day preliminary lien notice and had lien rights on a job. In error (while still working on the job) we filed a lien on the job, then realizing our mistake, we cancelled the lien. This actually removed the lien completely and lost us our lien rights.
