My contractor filed a lien against our property and never notified us. He had threatened to do it because we would not accept shoddy work and non-compliance with items listed in the contract. He issued a stop work order and we finished the project. We came to an agreement as to what we owed him and he accepted it. How do I get this lien off my property record? My ex boyfriend put a mechanics lien on my home back in September of 2021. I was in the process of selling my house and had already accepted an offer. I posted a bond to remove the lien and to close on my house. Now what do I do? I am in New York. I have reached out to the county clerks office and they told me it has to go through my ex’s lawyer. I sent a letter demanding for the following: Demand for Itemized Statement, Demand for Contractors License, Demand for Terms of Contract, Demand for Service of Copy of Notice of Lien. I received no response back. What are my next steps? The lien is exaggerated, he does not have a home improvement contractors license, he does not have any receipts, and there is no written contract. Furthermore, I never received a copy of notice of lien therefore failure to file proof of such a service with the county clerk within thirty-five days after the notice of lien is filed shall terminate the notice as a lien. I have a client that refused to pay the billing after I delivered all job materials due to their claim of unsatisfactory workmanship. Work done was done well within and above the standards expected. However, I did not file a peliminary notice when I took the order for the job. when does the preliminary get filed? before i deliver the materials? Im a residential property owner of 2 acres. Back in March of 2021, I started paperwork with Tilson Homes and was going thru their preferred lender for the loan. They had pre-approved me and was assured there would be no problem. So we proceeded to sign paperwork with Tilson. Later, their lender, informed me they wouldnt approve the loan without me reducing my debt to income ratio by paying off debt. That was something I wasnt able to do, so unfortunately I was forced to cancel due to their lender not approving the loan. Just yesterday, I found out by a Title of Property check that Tilson had a placed 2 Mechanic liens on my property. I reached to Tilson to have them removed due not being able to proceed due to their lender not approving the loan. They now are telling me that since I backed out of the contract I am liable for the 4.5% of the future total cost of the house built which would be approx. $17,000 of the $355,000. Good Evening We are building a home utilizing a construction loan. The General Contractor requested a draw to pay for “Top out Plumbing” in November but after talking to the plumber they were never paid. The General Contractor is requesting the draw again, to pay the invoice for the “top out plumbing”, but they are classifying it under a different plumbing draw. I have a signed contract with terms clearly stated that there's no breach of contract (on my part) if time delays are due to illness, holidays and Acts of God, however, I would now like to withdraw from an unfinished project that I am well extended on timelines due to things out of my control (illness with hospitalization, manpower over holidays). This 3 month projects has already taken 5 months and still lacks 2-3 at least. Rather than hold on to the contract to continue, can I, as the GC, dissolve the contract with the home owner with legal grounds? The foundation portion of the detached structure has just been completed with extensive excavation, plumbing, concrete. All City inspections have passed. We are at a good stopping point with balance between work and payments, in my opinion. My ultimate question here is, is does the GC have the option to dissolve a contract in Texas when the terms are being met but the contract timeline terms are just not realistic having unforseen circumstances happen after starting the project? ...Read More
