I am the GC working directly for the owner , dealing with the subs directly, however I do not right the checks nor pick which bid gets what job. I find multiple subs to bid and owner decide and I manage the project etc. Situation is , company owner chose for plumbing which guarantee the work for a year is not responding after being paid and finding that none of the pvc was sealed and the old cast iron that was paid to be removed, was just barried. So they made everything seem to work but after use several months, issues arise due to nothing being sealed. I hired another plumber I personally knew to investigate and found some other major issues. Am I responsible for that fee or is the owner? And am I able to get that money and time from client or owner? ...Read More

I have been dealing with two solar companies because they had sold me a solar panel system. In the end, a week later I decided to cancel the contract with Titan Solar because I decided that I didn’t need/want any solar panels and it would be too expensive. I had no problem and was able to cancel with Titan Solar because no work had started (no survey, no permits, or installation). But there’s a subcontractor (Solar Energy Auditors) that now is threatening and harassing me via phone and text that they want to put a lien on my property because they say that I owe them a 20% restocking fee ($12,000) because they had ordered the panels. They have even sent me a Notice to Owner letting me know that they will put a lien on my property. HIred a supposed electrician in Texas to wire up my swim spa. He said he was a master electrician; he didn't even have a license. He used the wrong size wire, hooked the spa directly to the pole box without a GFI switch or disconnect box and buried the wire in exterior piping not specified to underground. We had to hire another electrical company to totally redo all the work. He won't give us our money back and he could have actually electrocuted someone. I am a lower lier contractor, subcontractor to a subcontractor on a public works (Hospital owner is the country in San Antonio) providing labor only. We have been paid nothing. I filled all appropriate notices required by the state as well as intent to lien and actual lien. I want to file a new lien for the entire amount due inclusive of the extra signed work orders that are not paid for in addition to the additional contract. Can I legally do this?
