I am a homeowner. I hired a general contractor to complete renovations on my property and want to make sure that I am protected against any subcontractors etc. placing a lien on my property in case they are not paid by the general contractor that I am hiring. I will be able to prove payment to my general contractor through my receipts but have heard that I could still be liable if they don't pay the subcontractors. We have 3 signed contracts for a total of $117,000 but the customer asked us to leave the job 2 weeks before completion. $60,000 has been paid we filed our pre lien right after being removed from the job. On a current construction project, the title company is requiring conditionals and unconditional lien waivers for "lienable services" for vendors such as architects, engineers, surveyors, design professionals, and construction managers. These vendors do not provide furnished materials and do not contribute to any physical construction of the property. I thought lien waivers were only required for sub contractors who do physical work on the property. I am an unlicensed auto mehanic, a sole proprietor. Back in July of 2021 I spoke with a guy who had his car towed to my place on 8/9. I texted him screenshot of estimate. Several days later he agreed by text after I texted said I needed a response. A couple weeks later he said by text wanted to sell car. I agreed to buy it thru text.After several times not showing up as agreed H e finally just showed up in person to get things from vehicle. He had no title so I did not give him any money.Then on 2/11 I finally texted and told him to come get his car and he owed me $30 for estimate, $60 for 1 hour labor and $160 for the locksmith I had to pay. Also he needed to pick it up within 48 hours. and I was going to start charging storage fees. I discreetly texted him and he answered on 2/11 but has not answered my texts since I told him to come pay and get car. We completed this project 2019. The customer made two payment via credit card and then cancelled the payment . They told their credit card company we did not do the work, but we did. They paid us and signed off on us doing the work. Can we file a lien? We did not have the lien verbiage in our terms and conditions at that time. What are our options?...Read More

I'm a GC completed working on a residential in California. My contract is signed with the tenants, but payment has been coming from the owner. We have exchanged a few emails (with the owner) but all work orders have been coming from the tenant. I have a few questions: 1. I did not file a 20-day prelim notice. Does that invalidate my right to a mechanics lean? 2. I stopped building their cabinets 98 days ago. The work was incomplete. But they officially sent me an email stopping the work 82 days ago. Did I miss my deadline? Does it count from when the work stopped or from when they asked me to stop? They having been living in the home the entire time. 3.
