Georgia contractor filed a mechanics lien for a remainder portion of a project. The amount is in dispute due to (1) failure to perform; (2) improper performance; (3) negligence; and (4) failure of duty of care. The damage caused by the actions of the contract is likely more than the remainder amount per the signed contract. It is also found during dispute that contractor is not licensed in the State of Georgia, which makes them ineligible to file a mechanics lien or otherwise seek to enforce contract in the first place. We are a manufacturing company that is supplying materials to a general contractor for a project in New Jersey. We are not clear on the rules in NJ for what is considered first labor/material furnishing date. From our own research, we found conflicting information that we would use the date material was first delivered as furnishing date. But also read that if we provide a substantial amount of labor prior to delivery, which we do as we are a manufacturing company, we would use the date we first provided labor on the job such as fabrication, design, etc. We understand that preliminary notice is based on this first labor/material furnish date and want to make sure we are using the correct date. We are a material supplier that fabricates and ships metal panels for building exteriors. We supplied panels to a car dealership in New Jersey. A preliminary notice WAS sent, but sadly the deadline to file the lien was missed. We received a message through LevelSet that the deadline to foreclose on the line is in a few days. Hello. I recently got a call from the title company indicating that there's a lien to an LLC that own the property prior the LLC that I bought it from. I did my due diligence and bought the title insurance. However, the lien was done in 2020 but I purchase the home in December 2018. We did some change order work for our contractor by email request without a written change order (wasn't in the contract) and have yet to receive the change order to increase the contract for the work provided. Unfortunately, to my horror I realized I have issued lien waivers covering those months we did the work and didn't bill for so the amount was zero (oversight on my part).
