I'm a GC in California. I have a cabinet closet project. Pretty much turning a bedroom into walk in closet. Scope of work is was cabinets for new room, new lighting, painting walls and ceiling, and staining cabinets. Cost of job 63000.00. Got 50% upfront. I was in the middle of cabinet installation and got a call from the client to stop project. All electrical, demo, reframing, and ceiling painting was finished at this point. I also had all cabinets positioned for installation on site. Client said they wanted to sell house and cabinets were to custom for all potential buyers. I had already invoiced for another 29000.00 for second payment as I do once cabinets are on site. I talked to Client they wanted cabinets stored in the garage and would try to sell them to potential buyers. They told me to go forward with finishing the cabinet project in garage. An Indiana question: I am looking at this for two types of companies (providing residential not commercial work): an HVAC/Plumbing/Electrical provider and a General Contractor who primarily does kitchen, bathroom and basement remodels. A) On this site it states that a mechanics lien can be used for work that is a “permanent improvement.” I can see a house foundation as being permanent. However, does the above work qualify for a mechanics lien in Indiana due to the fact that after a period of time it would possibly be replaced? B) Also on this site, it states the mechanics lien is good for 1 year. 1) Is that true? 2) Does that mean it has to be re-filed each year? 3) Is it able to be refiled? C) Is the outlined mechanics lien strategy affected by the Indiana Home Improvement Contract Act; in what way?...Read More

We have completed the work around first week of January 2022 on an ADU remodel and an invoice has been sent. The city inspector has made request for customer's house electrical panel to be upgraded to 100 amps and a second panel for the ADU up to 60 amps after we completed work and passed all inspections including. I feel this is a separate work order and has nothing to do with the previous work we have done as client needs to hire a licensed electrician. I need to know my legal rights as not to be part of the inspector's request on the required electrical panels as client has been trying to include this within our scope of work....Read More

We liened a property in Canton, MA. The owners are in Miami FL. We have tried twice sending these documents to them but both times via USPS and Fed Ex it says unable to deliver sending back to shipper. Are we able to hand deliver these documents to the property where the work was done in Canton MA? How can we get these documents in the hands of the appropriate party?...Read More

Hello, We are a 2nd tier sub on a project we have been complete on for 7 months on one building, 5 months on the other. Both projects are privately owned. Both have separate notice to owners filed. Both are part of a multi-building park complex in FL. We did not sign a contract with the first tier sub. We are trying to get our retainage. The 1st tier sub continues to say they haven't been paid retainage and we must wait for that. The 1st tier sub has not even requested their final as of today 2/23/22. Both buildings are substantially completed, though I don't think the grounds of the park are substantially complete. I need to know if the FL payment laws apply?...Read More

I contracted with an entity to do some construction work on my property. (1) While one of the owners has a license under his name, the entity itself does not appear to have a license. Does that comply with CSLB requirements, or does the contracting entity need its own license? (2) Also, I suspect they used subs who are unlicensed. We have change orders that were requested via email and went ahead and did the work without a written change to the contract. Now we are seeking those written change orders so we can add them to the contract but nothing yet. Unfortunately, we issued lien waivers through the dates the work was done by mistake because technically they didn't owe us money we didn't bill for.
