Hello, I'm the contractor being suit by customer for breach of contract/ warranty. This lawsuit come after multiple attempts to settle with the customer for the best resolution but the only thing he want is money and a lot more then he deserves. He was the one who refused to pay when the schedule payment arrived and I tried to offer to do a walkthrough to check his concerns and also offer we can hire a 3 party we both agree on to fix what he's concerns about but he want to get cash base on inspection report done by a company he hired with ridiculous above market prices we didn't even charge him half of that. I am a material supplier on a job here in Texas. We provided ready mix concrete on a job, our customer was a sub contractor. The GC and Owner are the same entity. I have only been paid about half of the $20,645.28 that I am owed on the project. The Owner/GC has paid the sub (my customer) and he signed a lien waiver. I sent them the monthly notice but just received an email from them stating they are disputing it because they paid the subcontracor. The Owner Provision—O.C.G.A. §43-41-17 allows for an owner to construct a building or structure on his own "property". Does "property" extend to a condo? City of Atlanta owners affidavit for being their own contractor states "said property is zoned and will be used as a single-family residential structure". Is this affidavit legally correct OR is City of Atlanta breaking the law or the owner's provision in the code since the code does not explicitly define "property" as "zoned for single family residential structure"....Read More

Spectrum has been removed from the project and I sent a request to file a claim against the bond. I also received a Ratification Agreement from another company - SAGE - and was told they are acting as the middle person to allow other GCs to come in and complete the project and SAGE will be working with the bonding company to send payments. I was advised to file the bond claim and the ratification agreement by one person then to only file the ratification agreement by another person. We have a signed contract with a person that hired us to remodel their bathroom. They signed a contract 1 mth prior to original start date and the contract states material deposits are non refundable. We had to reschedule their project 2 times due to financial difficulties on their end, and then they cancelled the project 3 days prior to the final start date. We agreed to give them their material (we are unable to use it on a different project due to it being custom) and are waiting on them to schedule a time to pick up said material. Now they have decided to file a complaint on us with the better business bureau and will not resolve the claim until we issue a full refund. What can we do to stop them from slandering our company name, and resolve the claim without us issuing a refund? Any advise is greatly appreciated!...Read More

I have a customer who avoid paying me $16k, the job is finished and he keep dragging the payments by claiming he don't have money. I already filed a mechanical lien and again he said he will pay but didn't. He did gave me previously 4 checks of total $16k however they all bounced. What will be the best and cheapest route for me, to continue with the lien and file a foreclosure on it or to sue in court for giving me bad checks knowing he don't have money? 2 occurance with GC not paying us on time. Payment was due April 14th. Email Owner and GC to let them know that we are moving forward with lien if no response by May 19, 2002. Owner has terminated GC and is doing an audit of accounts. Owner responded saying the following: "I’d ask that you not please lien us just yet, we need time to work through the issues, but if you do lien us, we’re going to bond around the lien to buy us the time we require to finish auditing the project."...
