I’m a general contractor in California. Customer has decided to terminate me for convenience(clause included in contract)
It seems I should get her to sign some sort of agreement that she has in fact terminated for convenience rather than for cause
What sort of agreement? And can this include some sort of waiver of responsibilty for the contractor to complete job, and/or waiver of liability for work completed?
Thank you...Read More
I gave a personal loan for $34,000 so my friend could get into a house. I had proper documents and had it notarized. He has defaulted for one year and owes now the $34,000 plus interest of 20%. I want to put a lien ASAP because I just learned that he is not paying his house tax. What's crazy is the home has gone up over $80,000 and he still won't make payments. This is Los Angeles county in California.
Appreciate your help!...Read More
My company is a supplier for a job that was prelim-ed late last year and the customer requested an unconditional final in January. This release was signed because at the time there was nothing owed and the job was completed. In April the customer placed another order for this job and now the GC is refusing to pay because of the job was closed and the unconditional final was signed. We did not refile a prelim for the job in April, because we didn't notice the job was closed and done. Is there anything we can do?...Read More

I have a client that didn't pay her bill and therefore I filed a lien on her property. She claims that she never received the correspondence about the lien until she went to sell the property and said that since she never received the certified lien that it is null and void, even though I have a stamped copy by the clerk of court in the county of her property. I did track it through USPS and it looks as though it was never delivered nor returned. Is the client right? Is her lien null and void?...Read More

Can a contractor file a lien on my house if NO REPAIRS or work has actually been completed? I signed the contract almost 2 months ago. There is no price on the contract, it states I am required to pay a $2000 deductible and that's it. The contract also states that payment is required upon COMPLETION of each trade. The only thing that has been done is mold/asbestos testing, which I've already paid. I have given the contractor $4500.00 already and no work has been done on my house or even scheduled. No estimates have been sent to my insurance adjuster either.I am trying to use a different contractor because nothing is being done on my house but the contractor wants more money....Read More
