I was hired to work on a condo for a client. Now we are parting ways - he told me he was hiring someone else. He is not paying the invoice dated May 3rd, 2022 for work done. I have given him plenty of opportunity to pay and tried to open communication but all my attempts have been ignored. I have sent out an intent to file a lien on July 4th and he responded that he would pay $3,500 - ($6,245 is owed). Do I proceed to lien? Have I passed my time deadline? Can a General Contractor reduce the Subcontractor's scope of work for delays in performance by changing scope of work so that Subcontractor only back fills small amount of project and gives all the remaining high billing construction to the Subcontractor's own previously employed sub- Subcontractor who Quit? At this point the job is 95% complete, and the home owner texts me saying that he is terminating our contract, I have so far taken my deposit (1/2 of initial bid) Since starting the customers added and changed multiple details of the job. I can say that I did not meet my projected completion date, but that was in part due to the change orders and I was under the impression we had an understanding (the customer made these changes, not me). I would have to double check my books for exact , but the balance remaining is somewhere near $15,000. I also will add that in my written contract I added for this job due to the timing of when I was able to pour concrete that final payment would be due upon concrete placement. Following is the message I have received: "Jason Good evening!! We decided not going forward with you for many reasons 1. Lack of responsibility of your part. 2. breach of contract of your part with dates of finish ( our last change we gave you was last Thursday and you told us it will be finished on Saturday) Never happened 3. work disorganization of your company 4. lies and lies when it comes to supposedly working ( either your subcontractor can find you). 5. Promises and promises that never kept. WHEN WE CONTRACT YOU IS BECAUSE WE NEED THE BACKYARDS FOR KIDS IN OUR TIME NOT YOURS. We inform you that is enough and the contract is financially and physically terminated because We have to pay someone to FIX and finish what you guys did that it was incorrect on many parts with our project.
