In South Dakota we hired and paid a man $3000 in full to cut down a tree in our back yard. The price included rental of a lift. The man abandoned our job unfinished and failed to pay the rental company for the lift. The rental company is threatening to file a lien against our property for the cost of renting the equipment and the cost to repair damage they claim was caused to the lift. 2 Questions: 1) Per S.D. My company installed 10k worth of equipment for a customer. He paid the equipment fees up front with intent to pay labor once job was completed. Finished work May of 2022. Cx was on honeymoon and was supposed to make contact with ke after they returned. Cx total labor invoice with discounts was $3300+. When he made contact with me after 3 weeks, he informed me he has had other contractors come and inspect my work to which they gave a much lower price. Now customer doesn't want to pay for my services or finishing materials on-site and installed. He did pay $200 to which I told him I would take it off the total he owes. Per RCW 39.08.030 'such persons do not have any right of action on such bond for any sum whatever, unless within thirty days from and after the completion of the contract with an acceptance of the work by the affirmative action of the board, the subcontractor (my firm) must present to and file with such board..., a notice in writing'. We filed our Notice within 30 days of our last service. We provided rental equipment and labor to the project. Our customer (a subcontractor on the project) is asserting that we filed too early and that the 30 days to file is from the completion of the contract (as stated above). The Levelset deadline was set based on our last day of service. I'm concerned that the Levelset deadline may have been too early if calculated from our last day of service -- not 30 days from the completion of the contract. My company filed a lien of real property against the GC, he sold the property, and prior to the sale, we failed to file notice of lien agent. (NC lien laws are way different then our home state FL). The new owner sent us a letter telling us to cancel the lien, or they will move forward with a personal liability against us. So do we have any recourse? Could we file an intent to foreclose? and then move forward with a foreclosure lawsuit? or would we be better off filing a breach of contract? Or are we too late to do anything? What do we file? I’m a homeowner. There was a leak in my home and I contacted a mitigation company to assess the situation. They inspected the house and provided me an estimate. I ran the estimate by my insurance company for approval before giving the mitigation team the go ahead. I communicated with the mitigation company multiple times per day the entire time the air movers, etc were in place and have communicated several times since about their estimate for the repair work. I decided I would choose a different contractor for the repair work and called the mitigation company to pay my bill. It has tripled in amount. They didn’t run any changes or additions by me or my insurance adjuster for approval despite having many opportunities to do so. The insurance adjuster also says the new invoice is well outside industry standards, includes work that wasn’t done and advises me not to pay it. I am trying to pay the original amount, but if they don’t let me is it possible they can file a mechanic’s lien? I’m in Utah and the language in our laws is a bit vague concerning mitigation work from water damage....Read More
