The 60 day period for him to file suit has come and gone. How do I get the lien extinguished through the statute which says that it is automatic?...Read More

My question is as following : 1) Client has awarded us 100 $ worth of a job. 2) Client wants to open LC for 15% of the said job and "Claims" it can be re-utilized again and again as progressive milestones are achieved on monthly basis. 3) What kind of surety or clauses should be mentioned in the LC draft which secure and guarantee 100% of the project payment without any suprises mid way during construction or cancellations of LC by client during the job ongoing or to avoid delays in securing timely payments?? Hi, I have an issue with a customer, I renovated a pool and installed all new equipment. I provided an estimate to the customer in March and received a 30% deposit. Over the course of the renovation the customer requirements changed and I sent him a new estimate in August. I was supposed to collect 30% when the equipment was installed and the final payment when water was delivered. The equipment was installed the say day the water was delivered and I did not collect any money. Now the home owner states he isn't happy with the job and has not payed me. I have offered him a warranty on the work and asked him what he wants and he has still not made any effort to pay me. Can I put a lien on his property even though I don't have a signed contract?
