I'm a subcontractor and we had filed a Mechanics Lien on one of our projects and we were wondering if our General Contractor asks us to go back to the job site to complete some newly added change order work, can we remove our lien to have this work done? If so, would our lien rights deadline be reset another 90 days from the new date of completion? Also, would we be able to refile a lien if the Owner does not end up paying us? Just some additional questions: Does the change order have to be approved by the Owner before we can take any action? What if it's not for new change order work but for completion work from the original scope? Can the lien be removed and refiled? We used a third-party service (not Levelset) to file a notice for us on a public university project in Louisiana. The third-party uses an inhouse machine that post marks the notices as they are printed. For this project, the third-party printed & postmarked the notice several days before our notice deadline, but the envelope was not accepted at the post office until several days after our deadline. The third-party has stated the date accepted at the post office does not make a difference, and that the third-party has no control over when the envelope is accepted at post office. This seems doubtful, though, as any party could post mark a letter on a specific date and then walk it in to the post office days later. I'm a Sub contractor doing work (boring and pulling fiber) for another Sub on an AT&T project. We completed our work last month and have been unable to get the sub contractor that hired us to pay. We are currently trying to file a Mechanics lien and have submitted red-lined prints to the levelset research team, showing exactly where we preformed work but I'm being told that they cant find the exact legal description for this project, nor can they find the bond.
