Hello! We completed a portion of a contract job in Idaho. I billed the contractor who hired us on August 11th and inquired a couple of times about when to expect the payment. Each time he said he is still waiting for a draw from the bank. I just heard through the grapevine that he is in a bad way financially and multiple jobs have his have came to a halt. I gently reached out to the homeowner of the property we are working on to gauge the situation. ( I had worked with her directly on a couple details of the house) She informed me that the contractor had not paid the truss bill and the truss company had placed a lien on her property. She also informed me that he has only taken $2500 in draw towards our invoice of $20,000. In other words, technically he hasn't been paid for our portion. She said that all draws have been stopped and they will no longer be giving payment to him. I discussed with her getting my portion of the work paid for directly from her, as she hasn't paid for that portion yet. She then informed me that the budget amount that he had given her from plumbing was $12,000, however, our full contract is for $27,000. So now she is questioning how to pay the $20,000- as she only has a budget for $12,000 and has given him $2500. She directed me to contact her attorney- as it mostly seems she doesn't know what to do with the situation. I have reached out to her attorney twice but haven't gotten a response. She has a meeting coming up with him soon and she hopes to learn more at that time. My question, what do I do? Do I wait it out a week or get a lien issued right away?...Read More

We started this job on 9-14-2022. The job was for an HVAC replacement and was set to replace the condenser unit and the evaporator coil. The day before I found out that the condenser unit that I listed in the contract was unavailable until the following week. So I found another similar unit. We arrived at 9am on the 14th and informed the customer about the equipment issue and gave him the option of having us install the equipment we had or we could come back when we had the unit listed in the contract. The customer verbally agreed to have us install the replacement unit. Later in the day the customer started having issues with the way we were working. He was concerned that we had brought an evaporator coil that was slightly longer than the one that was originally installed in his house. He became so upset with this that he tried to cancel the job but I talked to him and assured him that fabrication for an HVAC replacement is normal on every job and that the unit would work just fine. He agreed and let us continue. Towards the end of the day my employee on the job was trying to install a new disconnect box and was looking for the breaker so that it could be done safely. In the process of doing that he mistakenly removed one of those tamper locks on the electrical meter. The customer was very upset about this even though I assured him that I would pay for any fines from PG&E. Towards the end of the day the customer became more and more troublesome. When one of the workers left the attic to help the other one outside the customer would go up into the attic and take pictures criticizing questioning our unfinished work. After the workers left the customer went back into the attic and sent me photos of the work claiming that the workmanship was bad. The next day I went back to complete the job. My workers were unable to charge the AC system the day prior. At that point the customer would not let us back in the house. He was claiming that our work was bad and unsafe, that we had "unlicensed" workers on the job, and that we installed the incorrect equipment without his approval. Since then I have given him 3 options. 1) We come back with the equipment that was in the contract. Then the system would be HERS rated and inspected. 2) We can finish the job with the existing equipment and a signed change order. Then the system would be HERS rated and inspected. 3) We can cancel the contract, return his money and take the equipment back with a signed document stating that he is satisfied and will take no further action. He has refused all of the options and says that he wants his money, gets to keep the equipment and will not sign anything. The customer is under the assumption that since we installed the incorrect equipment, that entitles him to all his money back. I believe this to be incorrect and as such we have made several attempts to be in compliance with the signed contract. Also, I found out when I pulled the permit that the man who signed the contract is not the property owner who is listed with the city. It's my understanding that this is illegal. We have a project that we completed for a brewery located on an apartments property. We attempted to collect payment for the project that we had completed about 3 months ago but were told that they (brewery) was waiting for a payment from the apartment complex before they would pay us. We filed a lien on the apartment to ensure we would get paid, but the Brewery says that the apartment won't give the brewery their disbursement now because we filed a lien. So they asked us to release the lien so the apartment will pay them and then they will pay us. As far as we are concerned our payment was not contingent on them receiving this money from the apartment so they should pay our invoice as they agreed to 30 day terms. My question is related to the following. We did a preliminary notice on an address that we thought was the location. This was to the best of our knowledge at the time. The customer did not pay. We contacted the GC but they agreed to pay us but then changed there mind and stated that they never received a preliminary notice. Looks like the job was near the location we had our equipment at. I was at the staring for my home improvement project. I had signed the contract with my Architecture to prepare the plan & get approval from city. I had paid the 40% money in advance $4000. He had made 3 visits in city but not able to get approval. After that COVID 19 situation came up. Due to this COVID 19 situation, I do have of safety & economic concerns.
