I’ve already missed the 4 month deadline that residential projects require, but I can still get it filed within the 8 months. Also, when I created the Lien yesterday and asked questions, I thought the only way the Leon could be stopped is if the owing party files a lawsuit. Today the phone person told me that I would need to file a lawsuit myself after a year if the lien is not paid, is that right? But if the house tries to sell before the lien expires, I will be able to collect my money upon closing? Or do we need to have the court involved either way? If I send a copy of the lien to the ower’s employment, will they be garnishing her check? Thanks....Read More

I am an Auto Mechanic and I own the business. I am just barely getting my business license. I have a customer who is not paying. I did not know about the 20 day preliminary form so I never mailed one. Am I still able to get a lien on this vehicle? Also am I required to send out the 20 day form? If so should I just sent one out for every customer I get? Also will it matter that I did not have a business license at the time of the repairs? Thank you for your time....Read More

My father's house burnt down almost a year ago. We decided to go with the contractor the insurance company is in contract with. The house has been down to the studs since April with no progress. I was just looking at the claim and found out the insurance company has paid the restoration company over $160,000 for content and dwelling. My question is, If the company has received payment why is no work being done and is this normal?...Read More

We attached conditional waivers to all billings. The retention bill was submitted with a Final Conditional Waiver (without exceptions) and paid. However, we have an unpaid progress bill that was previously submitted with a Progress Conditional Waiver. Our customer is claiming that payment for retention, which matched the amount on the Final Conditional Waiver, replaces all previous Progress Conditional Waivers and they are refusing to pay us. Is the Progress Conditional Waiver for the unpaid bill still enforceable?...Read More

However in that very case the financing company may burden a lose without turning back to the contractor for indemnity. I mean a kind of joint venture partnership but for achieving contract not establishing a business. Thanks for your kind support. machinexpert@gmail.com Mr nadjib labed ...Read More

I recently started my own General B residential remodling contracting business based in Oakland, CA. I formerly ran a branch office doing the same thing for the past 7 years at my former company but have struck out on my own. My first paid work opportunity has just arisen: I have been offered to be assigned 2 contracts from the company I used to work with that can no longer execute the work. Because my new company is so new in its formation, the proposed business structure we've worked out is that my new company CZB would be subcontracted the work from my former company for a period of time (roughly 6 weeks) while my CSLB license completes its setup. Once I am fully licensed, then the contract would be assigned to me. I am seeking advice from an attorney to review the documents prepared by my former company, and also to create a relationship with an attorney who could help me with contractual matters in the future. This is time sensitive as I am seeking review tomorrow 10/27/22 and to execute contracts on 10/28/22....Read More
