We completed a change order in which the superintendent told us what was needed to be done. No permits were pulled. When we completed the change order, we sent pictures to the superintendent via text and he said to close everything up and he had it worked out with the inspector. When the inspector checked, he found it was not completed to code. The superintendent no longer works for the company and the company wants us to pay to fix everything. We have been paid by the company for everything including that change order. Should we have anything to worry about, since we were following the orders of the company superintendent and we were given the ok to close everything up?...Read More

We are a GC and have multiple projects in CA with same client. We have completed work other than some work related to delays in getting certain equipment to site/installed (currently working off of temp equipment or generators). Client has occupied and is using facilities. We/our sub(s) will have to go back to site to do final install of permanent equipment once it is available. We have a supervisory person rotating to the various sites during this time as well. What would our lien deadline be? 90 days when last of work (install of permanent equipment) is completed, the date the owner took possession/put to use even with this outstanding work or ? If we didn't have a supervisory person checking in routinely during this time, would a cessation of labor apply, which then would extend our lien deadline?...Read More

The sub has been using a factoring company which we were not aware of. We’ve never received a preliminary notice or anything. The company has filed BK and is now using a DBA and apparently has not paid the factoring company yet. The factoring company reached out to us and demanded that we send the subs funding to them. Never had this happen so I am a bit confused, we know the sub has suppliers that need to be paid but unsure what to do with the factoring company....Read More

I am a steel fabrication subcontractor. I haven't filed any types of lien documents or notices. I sent my first invoice 3 months ago for $10K for detailing/blueprint cost. I have not received payment. I completed the job and sent my final invoice for $160K last month. I am scheduled to deliver steel to the jobsite soon. I fear that if I deliver the steel I lose all leverage. They have not paid me for 3 months on $10K. Who knows how long they'll wait on $160K. I'm contemplating holding all material and requesting payment in full. Can I get into legal trouble doing this?...Read More

I have a Gentlemen saying he delivered stone materials to my job site after all personnel was gone for the day, he left no kind of tickets or receipts for this material because it was never delivered I did not hear from this gentleman until around 2 weeks later with nasty texts and calls threatening me, so he eventually came out to job I explained to him we did not get what he is claiming and we could prove it with simple calculations of measuring the trenches he flipped out when I said this and said he file a claim because he knew the head guy in the office of the state agency I was working for, I not sure if he filed a lien or just put in some kind of claim I have no contract with him not even an invoice with our company name all my other suppliers were paid off before i even recieved payment and they wont release my last payment is this legal to do file false claims and the public job holing my check?...Read More

I drove from Georgia to do a deck for a "Friend" upon arrival He "Fills" Me in about Him having a Financial situation. Nevertheless, I stated to Him the expenses I paid to get to I Indiana from Georgia and requested those funds back, $250.00. He also paid a deposit of $850.00 to start the deck. Good afternoon My business partner who is also a wounded Veteran like me funded this project and house. We're known across the state for hiring vets and working for larger companies like Pulte etc. My business partner informed me yesterday that after 2 weeks he would have our company lawyer file a mechanics lien to hold all projects for Iqon/ Integra until the $2500 is paid to us which we have had done and is now been a month. I have no ill will towards anyone and since this is business, payment on time is very important. Especially to two veterans that are paying out of pocket to run this company from time served. I let Mike know yesterday that today would be that last day to pay our invoice otherwise further communication would be between my business partner if not the company lawyer. I hate that it's come to this. It also says on our site that failure to pay for our service within 24 hours of a specific time would result in potential removal of the insulation since it's still ours and legal action to be taken and the contract signed makes automatically goes into affect. Since I've worked with our client before in that past, I gave him the benefit of the doubt. But ignoring a good company like us especially veteran owned and waiting to pay if at all is not good business. Regardless, thank you for the chance to work with you. I just wish it was under better circumstances. I'll stay respectful through the whole process and have been since starting this project.
