Hello, I have a customer that we did work for from June to October and refuses to pay. She claims there is additional work required however, the work she wants done was not included in the scope of work on the estimate/contract she signed. We have sent numerous invoices and I filed an Affidavit of Lien on Homestead on 11/1. What do I do from here? I'm unsure if I missed a step or if there was a different document I needed to complete. My intention is to file a constitutional lien and sue to collect and foreclose....Read More

Hello, A quick question. Can a subcontractor file a mechanics' lien (or enforce a mechanics' lien) against a property if the business isn't properly registered with the Secretary of State to do business in that jurisdiction? In this case, Massachusetts is our jurisdiction. Thank you!...Read More

I am a subcontractor and was working for a GC. He didn't pay me for the last 3 weeks that me and my guys worked. I had a notice of intent sent to him and the home owner from Levelset but I am not a lic. contractor and afraid I can't file a Mechanic's lien. I wanted to know what options I had to recover the $8000 he didn't pay us. Also he became racist on the text messages, referring to me as "his nigger". After that I didn't respond his was humiliating and wrong. The following is our convo from Levelset...H Ally June 29 at 11:25 AM Already Paid - I have paid Sunil Remodeling LLC, $20,500. by checks and cash. Ck # 1379, 05/28/2022 $5000. Ck# 1372, 5/24/2022 $ 4000. Ck# 1371, 5/19/2022 $ 5000. Ck# 1367, 5/5/2022 $ 5000. Cash $1500. This company needs to provide an invoice or bills for its services. Also I need the insurances ( general liability, workers comp, and disability) and DCA license for working as a home improvement contractor. Also need proof of work completed. You Deoraj Seebarran June 30 at 3:15 PM I'm curious, what gave you comfort to pay the $20,500 from 5/5/22 thru 5/28/22 but not the remaining $8,000 owed for end of May thru the 3rd week of June? Whose license was used to obtain permits with the NY DOB? As stated before, I uploaded screenshots from our text conversation. There I listed the work I have done for you, and you haven't paid me or my guys for the last 3 weeks we worked for you. You ended the conversation by calling me "your nigger". You robbed me, disrespected, and insulted me, I am willing to settle for a lower amount than the $8,000, if not, then as you suggested we will let the courts decide, all evidence will be submitted there. Racist / Racism have no place in business or in society....Read More

We are a boyfriend/girlfriend contractor team who were hired to do a total home renovation and remodel in the state of Missouri by an individual owner. The owner did not draw up a contract and said they preferred a verbal agreement. Per the agreement, for compensation of the remodel, we were to be provided free housing and utilities on site the property we are working on with the promise of a rental property owned by the same person upon completion as well as daily compensation for food/materials/living expenses and the fulfillment of a paid invoice for the services completed. We have worked and lived on sight since July 9, 2023 and do receive mail at said residence. Payments have been spotted and sometimes completely withheld forcing us to aquire loans which are now unpaid. As well, the homeowner began entering our dwelling without notice or permission, rummaging through our personal items, and taking a very unhealthy interest in, especially the male figure in our equation, personal life and private affairs. Homeowner also began dictating how the earned wages should be spent opting to take us grocery shopping rather than paying us via cash, check, etc. After Homeowner became so engrossed in private affairs that she brought the male worker suppositories and demanded he gain a divorce in order to obtain the promised rental property upon completion of this job, the female in said partnership had a discussion with homeowner regarding professionalism and sat healthy and fair boundaries asking the homeowner to respect. Since this has taken place, the homeowner has stated "she doesn't like her anymore" and has attempted to retain the male both as a worker and resident in the home while kicking out the female without just cause or notice. The homeowner is refusing to pay the male until he gets rid of his female business associate and live-in girlfriend. Homeowner has even gone to the extent of contacting the ex boyfriend of the female, whom the female was a victim of abuse in said relationship, which was known to homeowner via intrusion of personal affairs, and allowed said third party to enter into the dwelling without supervision. Homeowner also gave third party access to the vehicle that was jointly owned by female and her ex to the ex boyfriend leaving female without transportation while demanding she be thrown out of property. It is winter and cold and with no source of compensation and no other forms of income, no transportation now, and no place to go due to not having relatives in Springfield area. Homeowner has not paid either party in 3 days leaving us without food or the ability to get any other needed resources. Homeowner is refusing compensation until demands that female, without just cause, be removed from property. Invoice for the cost of work completed up to this point have been furnished to the homeowner with refusal to pay. What can we do? It's cold outside and we fear being made homeless by this woman. She also sold the property promised to us upon completion of this project. As well, she bought a trailer and put it in the backyard of property where we work/live with a homeless man she just met occupying it to keep tabs on our coming/going. She has illegally connected shared power to this trailer and is now attempting to make us not only cover our own utility payment, but also that of the man she moved in. Person is suspected to be a drug user and does not have employment but receives shelter and money from homeowner. We are desperate to gain some insight as to our rights legally in this matter. She has been a constant source of harassment via telephone and in person visits on nearly a daily basis, screaming matches, slandering and falsely accusing female of things both professionally and privately, has threatened to call the cops on said female, and do whatever is necessary to make her life a "living hell" all the while encouraging male to join their alliance and break off all contact with female counterpart. Female feels discriminated against with just cause. Any information would be greatly appreciated. ...Read More

Our contractor agreed to a time and material job. Three months into the work he said he'll need 15% on top of time and material or he won't be paid for the job only his crew will be paid. We have signed no agreements with him and he is gaslighting us saying we forgot about that percentage, even though for sure it was never discussed. We have taken on the work of hiring and communicating with all subcontractors and arranging for them be on the project. Furthermore, he asked for that 15% in cash, so " I can pay my guys a tax free Christmas bonus." Is this a fair practice? ...Read More

I am the General Contractor for a project, in Hermosa Beach, I have spoken with the escrow office they told me directly that they see the registered lien but that the owner said to them that he would take care of the payment now with us, we have spoken to the owner, but he does not want to pay the total amount... since we were having a discussion I decided not to enforce lien nor thought to extend it, I am wondering now what do you believe is the best possible course of action now....Read More
