I was hired to do some concrete work and the owner wasn't satisfied with it and then the builder came at me and said that there was an issue with concrete work, so we came to an agreement that I was going to pay for the demo to take it down I was going to pay for the demo at my cost and once the demo was completed they gave me the invoice and it was 5 times the expected amount (bid that the builder went out and got). They are now trying to charge me for work and materials and time that was never mutually agreed upon. I had completed the first and second levels and was informed that they were unhappy with the first level. I told them I wasn't going to do the 3rd level because it was too high and wasn't safe, and if they were already unhappy and wanting it demo'd then why continue. Then the builder and I agreed that we were going to take one portion of the concrete down, so there was no reason for them to have the scaffolding and now they want to charge me or the scaffolding and 2 other charges plus other excessive charges such as picking up materials, scaffolding, meetings, "problem solving," checking and looking over work, communicating in via email/phone, going over questions, moving boxes, etc. I have insurance but need advice on what type of lawyer to consult with regarding this. I was a GC on a project with a real estate agent in Wyoming. On that project I am owed around $40,000. I also was involved with this person on a fix and flip project as well. My recently deceased sister and her husband were partners with me, and we put approx. 35k each into the project and this person was part was to finance the purchase and cover utilities. after a failed sales attempt they took it off the market rented it out and said to bad, your out your investment. I’m a general contractor who took on the role of a subcontractor with the homeowner acting as general contractor, I entered into contract to frame, side, and roof a home with a deposit up front and a draw upon completion of each phase. Upon completion of framing the home owner decided to not pay and trespassed me from his property, unprovoked and without reason. I received and lean for work done on a three level three unit apartment building and I live in one of the units the lien is an intent to lean it was sent registered mail but I never signed it because it was just put through the door. I did respond to the letter with the text to the contractor stating he sent me a bill a final bill and it did not show eight payments since last April. I am willing to pay the entire amount which dramatically exceeded the original budget due to construction problems such as plumbing and electrical that were not anticipated and four month delay in completing the project because of covid supply line delays. I'm a subcontractor. My contractor has 2 invoices that are due. He gave me a check for 1 invoice but not the second. The 1st check will not be "cleared" by my bank until several days after the mechanic's lien needs to be filed. The contractor is notorious for writing bad checks. Do I need to file 2 separate mechanics liens, one for the 1st invoice (that I have a check for but hasn't cleared) and 1 for the remaining outstanding balance? We have a project here in Davidson County / Nashville that we have filed a lien on for non-payment. Today the contractor sent over a lien waiver and a consent of surety to release retainage, whereas we are still awaiting payment on 2 progress payments. I think this is a ploy for the owner to side step TN retainage law penalties. I am inclined not to sign because the waiver has wording such as "the undersigned waives and releases any and all liens it has upon the foregoing described property to the extent of the payment received."
