We had some lumber delivered and paid for, but ended up not needing the size we had and our sales rep agreed to pick up what we did not need and drop off what we needed and we would just pay the difference, since the original drop was already paid for. The needed lumber was dropped, unneeded lumber picked up (we have pictures of return on truck) but we were never credited for the lumber picked up, only invoiced for drop. The initial contract with our customer included millwork and stone. Weeks later, the customer decided they wanted to add installation, which accounts for close to $150,000.00. When dealing with an owner who has a hard money loan who refuses to give a deposit on a $130,000 job that has a deadline in 4 months how many payments should I require. These payments would be upon completion of certain portions of the project. They also tried to get me to sign a lien waiver that stated I had been paid and post dated till due date of project. We send all of our clients a Preliminary Notice at the start of every project and an Unconditional Waiver and Release Upon Final Payment after final payment is received. One customer has actually asked us to sign a Conditional Waiver and Release Form Final Payment after we requested payment on the balance due. We are a Memphis, TN based flooring company and provide new flooring installations as requested for apartment communities. We provide services to two Florida properties managed and owned by the same company with large past due balances. We are new to Florida and have never been required to send a Preliminary Notice at 45 days - since each installation is a different job, does that 45 days start from the very first installation, or after each one? Does the preliminary notice requirement even apply to us? We do require new customers to sign a credit application that outlines our 30 day terms and the potential consequences of leaving balances unpaid, and the owner information is listed on that signed application - does that cover us as "contracted with the owner?" I have a friend who owns a house and hired a contractor to do some work. The contractor did not finish the work and my friend is unwilling to fully pay him. So the contractor has put a lien on his property for the 2000.00 expected to pay. The attorney fees that the contractor has incurred is 450 and they are expecting my friend to pay the 2000 and 450. My friend does not want to pay for this because the job was left unfinished and not done well. My friend has no intention of selling the house soon. Around 5 years ago, I had a plumber do work to unclog a sewer line for me on a rental property in Lee County, FL. I paid him $350. even though he failed to complete the job. He sent me an additional bill for $300. for extra time he spent, but STILL was unable to clear the line. So I paid another plumbing company who had the equipment to remove the shale in the cast iron pipes to allow the flow of the waste water. Problem solved. I spoke to the 1st company and argued that I should not have to pay their additional bill since they did NOT solve the problem and I had to hire a 2nd company who did. The 1st co. filed a mechanics lien on the property about about 5 years ago which I assume was done properly. Being extremely busy with other work of I had forgotten about it and am now wondering what kind of problem this will be for me. Is the lien still in effect? Do I have to pay or sue to remove it?
