I was designing custom homes for a small general contractor. More than once did he request an additional detail. Here's the slick part of what I saw as a way to defraud his clients. I did all the approved and recognized calculations for a spread footing with a reinforced stem wall, since that is the typical foundation here in Arizona for most soil types. He requested that I supply him with a detail for a monolithic slab. Where he stepped across the when he asked on a 2 story house. It's design required a lot of heavy cantilevered beams. I discovered that he had always asked the day the owners signed the contract. I know for fact that they were unaware because I asked directly. Was I wrong in my conclusion? If so, I walked away for no reason. I wasn't his employee, so I saw it as elevated risk. ...Read More

Hello. I had a contractor file a lien for work was not performed. In addition removed material off my property. I was forced to finalize the remaining work on my own. My question is the theft of materials considered conversion? As well, I have a detailed accounting of materials removed, work performed that contractor did not finish. To date, a lien was filed for $53,000 with no lawsuit. The frivolous lien was filed with a round number but not any invoices or any detailed accounting We have a thorough narrative and proof of work completed. How can someone perfect a lien in Montana without supporting accounting? In addition we are a brand new RV park with lost income due to the contractors dishonesty, and delay in opening. We have made continuous requests-demands for an accounting. Can someone just make up a false lien and file it with no accounting? Any advice would be much appreciated, In addition to a SW Montana attorney that specializes Mechanic Lien law-consruction litigation? Thank you for your time in advance. Matthew. My plumbing company is growing, and we’ve started picking up jobs in neighboring states. We have an office manager and an AR specialist who handle most of our accounts, but they’re getting overwhelmed with the financial side of things. They think we need to build a credit team to handle our collections, invoicing etc. as well as revamp our credit policy and billing process. I’m not sure we’re at that level yet. What should I do?...Read More
