As of August 14, 2020, at least eight mechanics lien claims were filed against the newly completed Canopy by Hilton project in Frisco, TX, totaling $2.66M in unpaid construction work, according to the lien affidavits.

Including the general contractor, eight different contractors have placed lien claims on the property owned by Supreme Bright Frisco III, LLC, a Texas developer. A mechanics lien is used to help force payment to contractors by preventing a property’s sale or refinancing while the claim is active.

The new 150-room Canopy by Hilton was constructed at Frisco Station, a 242-acre mixed-use development including 5 million square feet of planned office space, three residency towers, and three hotel properties. Frisco Station also houses the Dallas Cowboys’ world headquarters.

NewcrestImage, the project’s general contractor, developed each of the three hotels at Frisco Station, which is located 26 miles north of downtown Dallas along the Dallas North Tollway.

Seven of the lien affidavits were processed with the Collin County clerk’s office in Texas, while one claim was processed in Washington State with the Snohomish County clerk’s office.

8 Contractors Owed $2.66M

The eight contractors are allegedly owed a total of $2,660,151.53 for the construction of the Canopy by Hilton hotel at Frisco Station, located at 4455 Frisco Green Ave, Frisco, TX.

According to the lien affidavits, NewcrestImage filed the largest mechanics lien claim against Supreme Bright Frisco III, LLC pursuant to Texas statutes governing mechanics liens.

On April 20, 2020, NewcrestImage filed a $1,430,000 mechanics lien.

NewcrestImage is now named in at least seven mechanics lien claims from the remaining unpaid subcontractors on the same project, totaling $1,230,151.53.

The largest subcontractor lien was filed by a glass installation company on August 14, 2020, claiming $276,425.25 in unpaid work.

On March 27, 2020, JPL Enterprises, LLC filed the second-largest lien claim against the GC, valued at $252,492.15 for work performed between February and March of 2020.

Following the listing of a wrong property owner on a lien claim, a contract dispute has arisen between NewcrestImage and subcontractor Trinity Drywall & Plastering Systems, LP amid a lien claim valued at $245,065.39 from April 15, 2020.

Trinity Drywall & Plastering Systems was required to file a partial release of lien affidavit on June 22, 2020 for listing a wrong property owner. The partial release filing was used to release the wrong property owner’s land from the lien.

NewcrestImage Behind Each Hotel Project at Frisco Station

According to The Dallas Morning News, NewcrestImage was also the general contractor for the two additional hotels constructed at the Frisco Station. Before constructing the Canopy by Hilton, the GC had already constructed two Marriott properties, an AC Hotel and a Residency Inn.

The Dallas Morning News also reports that NewcrestImage is slated to construct a new 150-room Hyatt Place hotel at Frisco Station, which would mark the development’s fourth hotel. Upon the new hotel’s completion, Frisco Station will include over 600 hotel rooms.

The entire Frisco Station project is valued at $1.8 billion, and construction continues to progress as of July 2020.

In a statement published by The Dallas Morning News, NewcrestImage chairman and CEO Mehul Patel spoke of the newly constructed Canopy by Hilton amid the coronavirus pandemic.

“The opening of this Canopy symbolizes the story of hospitality’s comeback around the country and around the world,” said Patel. “Our company’s commitment to serve travelers is not a victim of coronavirus, and we have many hygiene procedures in place so guests can feel safe, comfortable, and special.”
