The Utah final payment waiver should be used when the final payment for a project has been made and received by the party that furnished labor or materials. Signing this waiver signifies that payment has been received and no further payments are expected following the payment described in the waiver.
This waiver is often a point of misunderstanding. Many consider this waiver to be unconditional, that if payment isn’t ultimately received, the potential lien claimant has already waived their rights when they signed. However, the statute itself and the language contained within states that the document becomes effective, “once the check is paid by the depository institution on which it is drawn.”
Utah is one of 12 states that has a statutory requirement for specific language to be included in the lien waiver.
